1. Scope
This notice applies to consumers in the EU/EEA purchasing purely digital content (software licenses, downloads, activation keys) not supplied on a tangible medium.
For orders by customers outside the EU/EEA (as well as for purely B2B transactions), no additional contractual right of withdrawal is granted; only mandatory consumer protection provisions at the consumer’s place of residence apply, where applicable.
2. Statutory right of withdrawal
You have 14 days to withdraw from the contract without giving reasons. The period begins at contract conclusion (purchase/license activation). A clear statement (e.g., email) is sufficient.
You may use a model form, but it is not required.
3. Early lapse for digital content
Important for software purchases:
The right of withdrawal may end early if:
- You explicitly consent to performance before the withdrawal period ends and
- You acknowledge the consequences (loss of the right).
If both conditions are met and the license has been fully provided (e.g., download link activated, license key sent), no later withdrawal right exists.
Practice note:
For purchases via Payhip, you will be asked to check a corresponding checkbox during checkout ("I agree that the download will be provided immediately and I lose my right of withdrawal"). This consent is legally required and protects both parties.
Note: It is essential that you explicitly consent to immediate provision before the 14‑day period ends and confirm the loss of the right of withdrawal. Without this confirmation, provision may still start, but the right of withdrawal does not automatically lapse.
4. Demo / trial versions
If you initially receive only a limited demo/trial without the final license key, the period continues. The lapse applies only after full performance with prior consent.
5. Effects of withdrawal (if still applicable)
If you withdraw in time (and the right has not lapsed), we will refund all payments promptly and at the latest within 14 days using the same payment method unless otherwise agreed.
6. Model withdrawal (optional)
Subject: Withdrawal – order number/product. Text: I hereby withdraw from the contract for (product, date). Name, address, email, date.
7. Marketplace purchases
If the purchase was made via an external marketplace (e.g., Payhip / FastSpring / PrestaShop / Shopware / VS Code Marketplace), their withdrawal rights and processes take precedence. Please follow the instructions of the respective marketplace. Our withdrawal right applies only where no prevailing marketplace right exists.
In particular, for Payhip (Merchant of Record), the purchase contract is concluded between you and Payhip; withdrawal/reversal is then handled via Payhip under their processes.
Custom-developed or customer-specific software (customization/services) is governed exclusively by our policies and is—where legally permissible—excluded from the statutory right of withdrawal.
Note on B2B: For business customers (B2B), statutory withdrawal rights generally do not apply. Contractual rescission/termination rights follow exclusively from the respective agreement.
